Facility policy concerning refunds, including the conditions under which a refund for advanced monthly fees will be returned in the event of a resident’s death, pursuant to Health and Safety Code section 1569.652. This requirement is not met as evidenced by: Based on interviews and record review, the licensee did not comply with the section cited above as R1's family / responsible party was not provided a prorated refund upon death of R1 per the facilities admission agreement, which posed a potential health, safety or personal rights risk to persons in care.
Licensee agreed to provide full refund owed to family and review section cited, review admission agreement then submit a statement of understanding and a written plan to ensure future compliance and submit to CCLD via email by COB 06/12/2026.
