What the official deficiency says

87468(a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (1) To be accorded dignity in their personal relationships with staff, residents, and other persons. This requirement is not met as evidenced by: Based on interviews and record review, the Administrator did not comply with the section cited above as S1, S2, and S3 were observed making rude comments and speaking inappropriately to Memory Care residents which poses an immediate personal rights risk for persons in care.

ED agreed to submit a statement of understanding on regulation 87468(a) and get all staff (including all shifts) trained on personal rigths and Elder Abuse. ED will submit memo provided to all staff regarding the training by POC due date.Training log will be sent to LPA by 6/5/2026.

87464 Basic Services (f) (4) Personal assistance and care as needed by the resident and as indicated in the pre-admission appraisal, with those activities of daily living...as specified in Section 87608, Postural Supports. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the above cited section, as R1 was not provided timely transfer assistance, which posed a potential health and personal rights risk to residents in care.

87465 (a) A plan for incidental medical and dental care shall be developed by each facility....such care, by compliance with the following:(4) The licensee shall assist residents with self-administered medications as needed. This requirement is not met as evidenced by: Based on interview and record review, the facility did not comply with the above cited section, as R1's morning meds were late on 03/08/2023 and 6 of R1's medications reviewed contained one more dose than the amount administered, which poses an immediate health risk to residents in care.

S1 is no longer employed by the facility as of 03/12/2023. Administrator agreed to provide medication training to all medication technicians and provide proof of training to CCL by 03/29/2023.
