What the official deficiency says

This is an amendment. Enumerated rights; severability (a) Residents of residential care facilities for the elderly shall have all of the following rights: (1) To be accorded dignity in their personal relationships with staff... (10) To be free from neglect,... punishment, humiliation, intimidation, and verbal, mental, physical, or sexual abuse. Based on interviews and records obtained, the licensee did not ensure staff complied with the section cited above in which caregivers tied R1’s arms to a wheelchair and upper body, which poses an immediate health, safety, or personal rights risk to persons in care.

Official plan of correction

Staff need training from CCLD Vendor on proper restraint alternatives and managing resident behaviors by an authorized vender of CCLD. Licensee must identify vendor by 01/09/25 and communicate with LPA in a timely manor as completion of all staff for all 4 hours of training required by this POC. Licensee to have training completed for all staff by 1/31/25.

(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1569.17(b) shall prior to working, residing or volunteering in a licensed facility: (3) Request a transfer of a criminal record clearance as specified in Section 87355(c) or This requirement is not met as evidenced by: Deficient Practice Statement Based on record review and interview, the licensee did not comply with the section cited above when one (1) facility staff was not associated to work in the facility but had fingerprint clearance and/or background check prior to working in the facility, which poses an immediate health and safety risk to residents in care.

87468.1 Personal Rights of Residents...: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment. This requirement was not met as evidenced by: Based on interviews with W1 and S2 the licensee did not comply with regulation above due to S2 answered the door without a mask on which poses an immediate health and safety risk to reisdents in care.
