80019 Criminal Record Clearance (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1522 shall prior to working, residing or volunteering in a licensed facility: (2) Obtain a California clearance or a criminal record exemption as required by the Department or (3) Request a transfer of a criminal record clearance as specified in Section 80019(f) or (4) Request and be approved for a transfer of a criminal record exemption, as specified in Section 80019.1(r), unless, upon request for the transfer, the Department permits the individual to be employed, reside or be present at the facility. This requirement was not met as evidenced by: administrator interview and record review where the fingerprinting for the facility was not complete for 2( one resident and one staff). This presents an immediate risk to health saftey and personal rights of the persons in care.
