This requirement is not met as evidenced by: Deficient Practice Statement Based on record review, the licensee did not comply with the section cited above in that 4 of 4 resident records did not contain signed personal rights documents which poses a potential personal rights risk to 4 of 4 residents in care.

POC Due Date: 09/19/2025 Plan of Correction Licensee stated that she will reach out to and request that residents or their responsible parties sign the personal rights document and keep a copy in each resident's file. Licensee will submit copies of the signed personal rights document to the Department by POC due date of 9/19/2025.

(e) All individuals subject to a criminal record review... shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department This requirement is not met as evidenced by: Deficient Practice Statement Based on LPA observation and record review, the licensee did not comply with the section cited above as Person 1 (P1) was not background cleared and was present at the facility for more than 5 days. This poses an immediate safety risk to 5 of 5 persons in care.

POC Due Date: 04/15/2024 Plan of Correction LPA observed P1 leave the facility prior to the end of the visit. Licensee will have P1 fingerprinted and will submit paperwork to the Department to have P1 criminal background cleared and associated to the facility prior to P1 returning to the facility.

This requirement has not been met as evidenced by: Based on interviews and LPA observations, the Licensee did not ensure activities were made available to residents. This poses a potential personal rights risk to 5 of 5 residents in care.

Licensee stated she will speak with the residents to learn what activities they would like and plan activities. Licensee stated she will develop and implement a written monthly calendar with daily activities. The Licensee will submit the calendar to the Department by POC due date.

This poses an immedate safety risk to 2 of 3 residents in care.

Licensee removed bedrails for R3 during the LPA's visit. Licensee will attend vendor training for postural supports and submit proof of completion to the Department by POC due date of 3/16/2023.
