(b)All individuals subject to a criminal record review pursuant ....... shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department This requirement was not met as evidenced by: Based on interview, records, and systems review, the licensee did not ensure Staff #1 had a CA criminal record clearance prior toworking or volunteering in the licensed facility which posed an immediate Health, Safety and Personal Rights Risk to person in care.

What the official deficiency says

Eviction Procedures. The licensee may, upon obtaining prior written approval from the licensing agency, evict the resident upon three (3) days written notice to quit. This requirement was not met as evidenced by: Licensee did not obtain written approval from Community Care Licensing prior ot issuing a 3-day notice to quit to R1, 1 of 8 residents in care. This posed a potential personal rights violation to persons in care.

Administrator agreed to ensure that licensee and administrator receive outside vendor training on proper eviction procedures in accordance with Title 22 regulations. Administrator agreed to provide proof of training to Community Care Licensing by the POC due date.
