Criminal Record Clearance: (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1569.17(b) shall prior to working, residing or volunteering in a licensed facility: (2) Request a transfer of a criminal record clearance as specified in Section 87355(c) This requirement is not met as evidenced by: Deficient Practice Statement Based on observation and record review, the licensee did not comply with the section cited above in 2 of 2 staff present, which poses an immediate safety risk to persons in care. LPA Colvin observbed both staff present at the facility to not be associated to the current facility, or any other facility.

This requirement is not met as evidenced by: Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above in 2 of 2 staff files,which poses an immediate safety risk to persons in care. LPA Colvin was unable to gain access to files for staff currently present at the facility in order to verify employement start date.

Personal Rights of Residents: Residents...shall...be free from punishment, humiliation, intimidation, abuse... This requirement was not met as evidenced by: Based of interviews and record review, On 1/12/21 Staff 1(S1) placed Resident 1(R1)'s bedside table over R1's legs as a restraint. This is an immediate health and safety risk to residents in care.
