PERSONAL RIGHTS OF RESIDENTS IN ALL FACILITIES: (a) Residents in all RCFEs shall have all of the following personal rights: To be free from punishment, humiliation, intimidation, abuse, or other actions of a punitive nature, such as withholding residents’ money or interfering with daily living functions such as eating, sleeping, or elimination. This requirement was not met, as evidenced by: Based on interview & observation, the Licensee did not ensure residents had access to food. Interview revealed staff utilized a lock on the refrigerator door due to a resident taking items out & not eating what was removed.

The facility shall be clean, safe, sanitary and in good repair at all times. Maintenance shall include provision of maintenance services and procedures for the safety and well-being of residents, employees and visitors. This requirement is not met as evidenced by: Deficient Practice Statement Based on LPA Delgado's observation during the inspection at the facility, the door knob to the laundry room was broken, the latch for the gate on the south side of the home is broken and gate can not easily be opened, hospital bed in front yard, interior roof in caregivers room has a hole and covered with material for the boiler and wood fencing in back yard held up by two wood poles, the licensee did not comply with the section cited above in which poses/posed a potential health, safety or personal rights risk to persons in care.

Storage Space: (a) Disinfectants, cleaning solutions, poisons, firearms and other items which could pose a danger if readily available to clients shall be stored where inacessible to clients. What the official deficiency says

Reporting Requirements. Occurrences, which threaten the welfare, safety or health of residents, personnel or visitors, shall be reported within 24 hours either by telephone or facsimile to the licensing agency and to the person responsible for the resident. On 5/31/2020 Resident #1 left the facility and did not return and law enforcement was not immediately made aware of the incident.

Licensee shall immediately review and train all staff on Section 87211 Reporting Requirements and develop a plan so that this type of incident does not happen again. The plan and proof of training shall be provided to CCLD by the POC date of 12/9/2021.
