87465 Incidental Medical and Dental Care (h) The following requirements shall apply to medications which are centrally stored: (1) Medications shall be centrally stored under the following circumstances: (A) The preservation of medicines requires refrigeration, if the resident has no private refrigerator. This requirement is not met as evidenced by: Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above in 1 out of 1 medication stored in a fridge in the garage, accessible to residents, which poses/posed a potential health, safety or personal rights risk to persons in care.

POC Due Date: 11/01/2024 Plan of Correction Caregiver removed the medication from the fridge and properly disposed it. Licensee will conduct staff training regarding the proper procedure for disposing medication. Licensee will submit proof of training to LPA by the plan of correction date

87468.1 Personal Rights of Residents in All Facilities (a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (6) To leave or depart the facility at any time and to not be locked into any room, building, or on facility premises by day or night. This does not prohibit a licensee from establishing house rules, such as locking doors at night to protect residents, or barring windows against intruders, with permission from the Department. This requirement is not met as evidenced by: Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above in 2 out of 2 gates observed to be locked, which poses/posed a potential health, safety or personal rights risk to persons in care.

This does not prohibit a licensee from establishing house rules, such as locking doors at night to protect residents, or barring windows against intruders, with permission from the Department. This requirement was not being met as evidenced by: Based on observation, and staff interview, the sliding lock prevents the residents from leaving the facility. This presents a potential personal rights violation to residents in care.

Postural Supports: (a) Based on the individual's preadmission appraisal, and subsequent changes..provide assistance and care for the resident in those activities... Postural supports may be used under the following conditions. (1) Postural supports.. spring release trays..to improve a resident's mobility.. functioning, or to position rather than restrict movement including, but not limited to, preventing a resident from falling out of bed, a chair, etc. This requirement was not being met as evidenced by: Based on staff interview and LPA observation, R1 had a box wedged between the bed and frame preventing R1 was exiting the bed. This poses an immediate personal rights risk to residents in care.

Licensee agrees to develop a plan to provide supervision for R1 and further agrees to conduct in-service training on personal rights and cited regulation, and provide proof of training by POC date.

Managed Incontinence (b) In addition to Section 87611...licensee shall be responsible for the following:(3) Ensuring that incontinent residents are kept clean and dry and that the facility remains free of odors from incontinence. This requirement was not met as evidenced by: Based on staff interview, LPA found that staff are to change resident's before breakfast and/or inquire if they need changing. This was not done for R1. This poses a potential personal rights risk for residents in care.
