(11) To have their visitors, including ombudspersons and advocacy representatives, permitted to...during reasonable hours and without prior notice Based on LPA's observation, the Licensee posted visiting hours at the entrance of the facility which poses potential personal rights violation to residents in care.

What the official deficiency says
(c) (3) " Care and Supervision " means those activities which if provided shall require the facility to be licensed. It involves assistance as needed with activities of daily living and the assumption of varying degrees of responsibility for the safety and well-being of residents. " Care and Supervision " shall include, but not be limited to, any one or more of the following activities provided by a person or facility to meet the needs of the residents: This requirement was not met as evidenced by: Based on the Department’s records review and interviews conducted the Licensee did not ensure sufficient staffing levels were provided as specified by the Program Plan and Admission Agreement. This poses an immediate risk to the health, safety and personal rights of residents in care.

What the official deficiency says
Criminal Record Clearance: (e) All individuals...shall prior to working, residing or volunteering in a licensed facility: (3) Request and be approved for a transfer of a criminal record exemption, as specified in Section 87356(r).... This requirement was not met as evidenced by: Based on record review, the Licensee did not comply with the above regulation with at least one staff member (S1). LPA Colvin observed that S1 has been working at the facility since 2020, but has not requested for their exemption to be transferred. This is an immediate safety risk to all residents in care.

Licensee agrees to remove S1 from the schedule until S1's exemption transfer is approved. Licensee to provide LPA Colvin with an updated staff schedule for the month of April 2022 without S1, or provide LPA Colvin with proof of S1's approved exemption transfer. Documents due by 4/7/22.
