87468.1 Personal Rights of Residents in all Facilities (3) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment. This requirement is not met as evidenced by: Based on evidence and video footage, Licensee did not comply with the section cited above evidenced by Staff #2 (S2) improperly lifting Resident #1 (R1) and sustained bruising from using gait belt which poses an immediate health, safety, and personal rights risk to those in care.

What the official deficiency says
A written report shall be submitted to the licensing agency and to the person responsible for the resident within seven days of the occurrence of any of the events specified in (A) through (D) below. This report shall include the resident's name, age, sex and date of admission; date and nature of event; attending physician's name, findings, and treatment, if any; and disposition of the case.Any incident which threatens the welfare, safety or health of any resident, such as psychological abuse of a resident by staff or other residents, or unexplained absence of any resident. This requlation was not met as evidence by: staff did not submit an incuident report to CCL for the medication refusal.

What the official deficiency says
If the resident's physician has stated in writing that the resident is able to determine and communicate his/her need for a prescription or nonprescription PRN medication, facility staff shall be permitted to assist the resident with self-administration of his/her PRN medication.Once ordered by the physician the medication is given according to the physician's directions.This regulation was not met as evidenced by, The Medication Administration Record (MAR) indicates that the medication was not given according to R1's physician’s order. This poses a health and safety risk to residents in care.
