(c) If the resident's physician has stated in writing that the resident is unable to determine his/her own need for nonprescription PRN medication, but can communicate his/her symptoms clearly, facility staff designated by the licensee shall be permitted to assist the resident with self-administration, provided all of the following requirements are met: (2) Once ordered by the physician the medication is given according to the physician's directions. This requirement is not met as evidenced by: Deficient Practice Statement Based on observation, interview and record review, the licensee did not comply with the section cited above by not ensuring that Resident #8 (R8) three (3) medications were given according to R8 physician's directions, as evidenced of the 3 medications were observed to be missing in the medication room and two (2) of Resident#9 (R9) medications were observed to be missing in the medication room and R9's medications were not given per R9's physicians directions, which poses an immediate health, safety or personal rights risk to persons in care.

Reappraisals (c) The licensee shall arrange a meeting with the resident, the resident’s representative, if any, appropriate facility staff, and a representative of the resident’s home health agency, if any, when there is significant change in the resident’s condition, or once every 12 months... Based record review, the licensee did not comply with the section cited above evidenced by reappraising and updating R1’s Personal Service plan on 10/10/2020 without informing R1’s responsible party of the changes which poses a potential health, safety, or personal rights risk to persons in care.

Reporting Requirements: A written report shall be submitted to the licensing agency & to the person responsible for the resident within seven days of the occurrence of....Any incident which threatens the welfare, safety or health of any resident, such as psychological abuse of a resident by staff or other residents, or unexplained absence of any resident. This requierment was not met as evidence by: LPA requested to review Resident 1's (R1's) file. LPA noted several entries that met the criteria for the facility to complete and submit a special incident report (SIR) to licensing. The facility did not submit an SIR for the incidents. This poses a potential risk to residents in care.
