What the official deficiency says

87307 Personal Accommodations and Services.(a)Living accommodations...shall be related to the facility's function... Equipment and supplies necessary for personal care and maintenance of adequate hygiene practice shall be readily available...(C)clean linen, including blankets, bedspreads, top bed sheets, bottom bed sheets, pillow cases, ...shall be sufficient to permit changing at least once per week or more often...to ensure that clean linen is in use by residents at all times..This requirement is not met as evidenced by: The Licensee did not comply with the section cited by R1 had several ants on bed and assessed with poor hygiene, which poses an immediate health, safety or personal rights risk to persons in care.

Two staff immediately changed R1's bed linen and mopped the floors. The Licensee and/or Administrator shall submit to the Licensing Agency a written certification of understanding on the regulation cited by POC date.

Additional Personal Rights of Residents in Privately Operated Facilities(a) In addition to the rights listed in Section 87468.1, Personal Rights of Residents in All Facilities, residents in privately operated residential care facilities for the elderly shall have all of the following personal rights:To be protected from involuntary transfers, discharges, and evictions A licensee shall not involuntarily transfer or evict ....This requirement is not met as evidenced by: Based on the interviews with staff & clients the licensee did not ensure clients were protected from an involuntary transfer.

87705.Care of Persons with Dementia. (b) In addition to the requirements as specified in Section 87208, Plan of Operation, the plan of operation shall address the needs of residents with dementia, including:(2) Safety measures to address behaviors such as wandering, aggressive behavior and ingestion of toxic materials. This requirement was not met based on evidence by interview, observation, and document review. The licensee did not comply with the section cited above by not having safety measures in place to keep dementia resident with wandering behaviors safe which poses an immediate health, safety or personal rights risk to persons in care.

The licensee has agreed to read regulation 87705 entirely and send LPA letter stating that the regulation was read and understood. The licensee has agreed to put a plan in place to ensure that resident’s with wandering behaviors are addressed and residents in care are safe. sent to LPA by the POC date 1/5/2022.
