What the official deficiency says

87355 Criminal Record Clearance (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1569.17(b) shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by: One uncleared and unassociated individual was present in the facility upon LPA's arrival which poses a threat to the health and safety of the residents in care.

The licensee agrees to have the individual fingerprint cleared and associated before being allowed to work in the facility. The individual was asked to leave by the Licensee/Administrator. The individual went to get fingerprinted and the licensee will contact me once the individual is associated to the facility.

A refund of any fees paid in advance covering the time after the resident’s personal property has been removed from the facility shall be issued to the individual.. to the resident’s estate, within 15 days after the personal property is removed.
