What the official deficiency says
(a) Each licensee shall furnish to the licensing agency such reports as the Department may require, including, but not limited to, the following: (1) A written report shall be submitted to the licensing agency and to the person responsible for the resident within seven days of the occurrence of any of the events specified in (A) through (D) below. This report shall include the resident's name, age, sex and date of admission; date and nature of event; attending physician's name, findings, and treatment, if any; and disposition of the case. (B) Any serious injury as determined by the attending physician and occurring while the resident is under facility supervision. This requirement is not met as evidenced by: Based on interview and record review, the facility failed to submit a Special Incident Report (SIR) for R1’s hospitalization that occurred between 03/06/2026 to 03/09/2026. This poses a potential health, safety or personal rights risk to persons in care.

(b) Upon the occurrence, during the operation of the facility, of any of the events specified in (1) below, a report shall be made to the licensing agency within the agency's next working day during its normal business hours. In addition, a written report containing the information specified in (2) below shall be submitted to the licensing agency within seven days following the occurrence of such event. (1) Events reported shall include the following: (D) Any injury to any client which requires medical treatment. This requirement is not met as evidenced by: Based on interview and record review, The facility contacted Resident #1 (R1’s) responsible party on 2/25/2026 regarding the incident that occurred involving R1’s eye injury on 2/24/2026. However, the facility failed to notify licensing since there was no special incident report (SIR) sent from the facility to the department of R1’s eye injury. This poses a potential health, safety or personal rights risk to persons in care.

Personal Rights of Residents in All Facilities (a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (3) To be free from punishment, humiliation, intimidation, abuse, or other actions of a punitive nature, such as withholding residents’ money or interfering with daily living functions such as eating, sleeping, or elimination. This requirmenent was not met as evidenced by: S1 physically abused R1 which poses an immediate threat to the physical health, mental health, or safety of residents in care.

Administrator will certify a plan on when staff re-training will be conducted for ALL staff that provide direct care and supervision to residents and those who assist residents with activities of daily living. Certified plan must be emailed to LPA Ramirez by 06/08/25. Re-training shall cover regulation 87468.1(a)(3). Proof of re-training shall be emailed to LPA Ramirez by 06/18/25.

Additional Personal Rights of Residents in Privately Operated Facilities: (a) In addition to the rights listed in Section 87468.1, Personal Rights of Residents in All Facilities, residents in privately operated residential care facilities for the elderly shall have all of the following personal rights: (4) To care, supervision, and services that meet their individual needs and are delivered by staff that are sufficient in numbers, qualifications, and competency to meet their needs. This requirement was not met as evidenced by the facility’s failure to develop a care plan based on the resident’s specific needs and to address the resident as a fall risk Based on interviews and records, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care.
