What the official deficiency says

Admission Agreement: (g) Admission agreements shall specify the following: (5) Refund conditions. (E) Preadmission fees shall be refunded... 1. A 100 percent refund... shall be provided to an applicant or the applicant’s representative if: a. The applicant decides not to enter the facility... This requirement was not met as evidicence by: Based on interviews licensee did not comply with the section cited above by failing to refund $1000 to R1's authorized representive after R1 passed away. This poses a potential health, safety or personal rights risk to persons in care.

87307 Personal Accomodations & Services(d) The following space and safety provisions shall apply to all facilities: (6) All outdoor and indoor passageways and stairways shall be kept free of obstruction. This requirement was not met as evidicence by: Based on LPA's observation staff did not comply with the section cited above in that staff blocked the exit door with a long heavy cardboard box which poses an immediate health, safety or personal rights risk to persons in care.

LPAs observed the caregiver remove the box. LPAs discussed with the Administrator and caregiver that the exit door cannot be blocked. The Licensee will conduct an in-service training for all staff on the cited section by the POC due date and provide LPA with signatures of all staff that have completed the training.

This requirement was not met as evidence by: Based on observation the Licensee did not comply with the section cited above in that a lighter was found in an unlocked draw in the kitchen, which poses an immediate health, safety, or personal rights risks to persons in care.
