What the official deficiency says

(a) All facilities shall maintain a fire clearance approved by the city, county, or city and county fire department or district providing fire protection services, or the State Fire Marshal. Prior to accepting or retaining any of the following types of persons, the applicant or licensee shall notify the licensing agency and obtain an appropriate fire clearance approved by the city, county, or city and county fire department or district providing fire protection services, or the State Fire Marshal: (2) Bedridden persons This requirement is not met as evidenced by: Deficient Practice Statement Based on observation and record review, the licensee did not comply with the section cited above. The facility does not have fire clearance for additional 1 resident (R3) residing in Room 1 which poses an immediate health, safety or personal rights risk to persons in care.

(c) To accept or retain a person who is bedridden, other than for a temporary illness or recovery from surgery, a licensee shall obtain and maintain an appropriate fire clearance as specified in Section 87202, Fire Clearance. This requirement is not met as evidenced by: Deficient Practice Statement Based on observation and record review the licensee did not comply with the section cited above. Administrator accepted and retained R3 person who is bedridden, which poses an immediate health, safety or personal rights risk to persons in care.

POC Due Date: 07/18/2025 Plan of Correction The licensee will apply for the appropriate fire-clearnace to retain R3. If the fire clearance cannot be approved by the city, county, or city and county fire department, or district providing fire protection services, or the State Fire Marshal, the licensee will need to relocate R3. An immediate Civil Penalty (CP) was assessed for $500 today for fire clearance violation. This CP will continue to accrue at $100/day if the licensee fails to correct this deficiency.

What the official deficiency says

Criminal Record Clearance. Prior to working, residing or volunteering in a licensed facility, all individuals subject to a criminal record review shall obtain a clearance or criminal record exemption. This requirement was not met by evidence of: Based on the physical plant tour. The Licensee has rented the staff room to a tenant which poses an immediate health, safety, or personal rights risk to persons in care.

The administrator agreed to remove the tenant. An immediate Civil penalty of $500.00 has been assessed. The licensee and administrator will be invited to an informal meeting at the CCL Woodland Hills office.
