What the official deficiency says

(a) Except for children’s residential facilities, each client shall have personal rights which include, but are not limited to, the following: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: Based on observation and interviews facility did not comply with the cited section, as the facility had a surveillance camera placed in a residents shared room which poses/posed an immediate health, safety, or personal rights risk to persons in care.

Official plan of correction

Licensee shall immediately ensure that no video surveillance cameras are installed in resident bedrooms without prior Department approval.In addition, the Licensee shall provide documentation that all staff have been trained on residents' personal rights, privacy requirements, and the facility's policy regarding video surveillance. The written plan and proof of staff training shall be submitted to LPA by the POC due date.
