87468.1 Personal Rights of Residents in All Facilities (a) Residents in all residential care facilities for the elderly shall have all of the following personal rights:(1) To be accorded dignity in their personal relationships with staff, residents, and other persons. The following requirement has not been met as evidenced by: Staff 1 does not treat facility residents with dignity and respect, which poses a potential, health, safety or personal rights risk to residents in care.
Facility Administrator/ Wellness Director will conduct Personal rights of residents and Staff Proffesionalism training with facility staff, and submit to LPA by POC date of 06/20/2026.

(c) A refund of any fees paid in advance covering the time after the resident’s personal property has been removed from the facility shall be issued to the individual, individuals, or entity contractually responsible for the fees or, if the deceased resident paid the fees, to the resident’s estate, within 15 days after the personal property is removed. This deficiency was not observed as evidenced by LPA. R1 did not receive its refund in timely manner, which poses potential health and safety risk to persons in care.

87468.1(a)(1) Personal Rights of Residents in All Facilities (a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (1) To be accorded dignity in their personal relationships with staff, residents, and other persons. This requirement is not met as evidenced by: Based on observations, interviews conducted and records reviewed, Staff inappropriately transferred resident from one room into another room. Resident’s (R1) mattress was lifted with resident on the mattress and resident was carried to another room. Resident’s mattress was placed on the floor several times during the transfer.
Administrator agrees to submit a statement of intent by due date to provide staff with personal rights training. Once training is completed, Administrator will submit documentation of training to CCLD.

87303(a) Maintenance and Operation (a)The facility shall be clean, safe, sanitary and in good repair at all times. Maintenance shall include provision of maintenance services and procedures for the safety and well-being of residents, employees and visitors. This requirement is not met as evidenced by: Based on interviews conducted and records reviewed, resident’s (R1) AC unit stopped working on February 27, 2026 in Room #10. Facility had AC technicians inspect the AC unit on February 28, 2026 and March 2, 2026 and were informed Control Circuit board is not operating for Rooms 10, 11,12. Observations during inspection; AC in room 10 was inoperable. AC units in the other rooms would work temporally.
Administrator is already working with McKenny’s Air Conditioning Inc and is waiting for a part to be replaced. Administrator agrees to place fans/ portable air conditioner in rooms and/or move residents to a room with working AC unit.
