Prior to accepting or retaining any of the following types of persons, the applicant or licensee shall notify the licensing agency and obtain an appropriate fire clearance approved by the city, county, or city and county fire department or district providing fire protection services, or the State Fire Marshal: This requirement is not met as evidenced by: Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above by having fire extinguisher that was purchased on 6/16/21 and has not been serviced which poses/posed a potential health, safety or personal rights risk to persons in care.

Personal Rights Residents in all residential care facilities for the elderly shall have all of the following personal rights (3) To be free from punishment, humiliation, intimidation, abuse, or other actions of a punitive nature, such as withholding residents’ money or interfering with daily living functions such as eating, sleeping, or elimination This requirement was not met as evidenced by staff disrupting resident's sleep due to reheating food during meal breaks which posed a potential health & safety risk to resident in care

Admission agreements shall be signed and dated, ... no later than seven days following admission. Attachments to the agreement may be utilized as long as they are also signed and dated as prescribed above. This requirement is not met as evidenced by: Based on observation and interview, licensee failed to ensure that a completed Admissions Agreement is placed in the record file of R1.

Licensee shall arrange a meeting with R1 and/or R1's representative to complete all pages of an Admissions Agreement. Licensee shall submit copy of completed Admissions Agreement, dated and signed licensee, resident and/or resident's representative, to CCLD by POC date 5/30/22

§1569.625 Staff training; legislative findings; contents : (a)(b)(1)....require staff members of residential care facilities for the elderly who assist residents with personal activities of daily living to receive appropriate training. This training shall consist of 40 hours of training. A staff member......shall be completed within the first four weeks of employment. -This requirement is not met as evidenced by: -Based on records review and interview, the licensee did not comply with the section cited above for not having S1 and S2 complete the required hours of training which poses potential health, safety and personal rights risks to persons in care.
